On June 23, 2023, U.S. Customs and Border Protection (CBP) announced in Cargo Systems Messaging Service (CSMS) #56727800 the publication of the final rule (88 FR 41224) that requires continuing education for licensed customs brokers. The Federal Register Notice states “CBP’s framework will enhance professionalism and competency within the customs broker community. CBP has determined that this framework will contribute to increased trade compliance and better protection for the revenue of the United States.”
The final rule will become effective July 24, 2023. “While the Final Rule states that brokers must complete 36 continuing education credit hours per triennial status period, CBP will allow brokers to complete fewer than 36 hours to meet the requirement for the initial 2024-2027 triennial status period. Further guidance on how many continuing education credits will be required for the 2024-2027 triennial status period will be published on CBP.gov and in a Federal Register notice.” The first required reporting of compliance with this regulation will be in the February 2027 Triennial Status Report.
CBP created a new webpage dedicated to continuing education for licensed customs brokers and a fact sheet to answer questions. Educational opportunities will be available from CBP, Partner Government Agencies (PGAs) and, accredited non-governmental sources once they are selected.
