CBP Updates AD/CVD Messaging and Type 86 Entry Timing

Antidumping and Countervailing Duty (AD/CVD) Cargo Messages

On January 16, 2024, U.S. Customs and Border Protection (CBP) implemented new cargo messaging to communicate with the filer on entry summaries that are potentially noncompliant for AD/CVD. As part of increased enforcement, CBP will be seeking additional confirmation from the importer to ensure compliance on entry summaries that are disclaimed for AD/CVD.

 

“Specifically, CBP is aiming to address AD/CVD entry summaries that appear to have omitted companion AD or CVD case numbers and/or applied an improper company-specific 10-digit AD/CVD case number. When corrective action is taken by the filer to address the potentially noncompliant AD/CVD issue while the entry is still in trade control, this may reduce the need for further action by CBP for the identified issue.”

Entry Type 86 Timing Changes

As a result of the updated Federal Register Notice (FRN) on the ACE Entry Type 86, the deadline to file Entry Type 86 was amended from “within 15 days” of arrival of the cargo to “upon or prior to arrival” of the cargo. On January 27, 2024, CBP deployed the “Update to the Timing of Entry Type 86 Release messages (1C) in the Air Environment (Non-Express) enhancement to the Automated Commercial Environment (ACE).” This change modified “the timing of the automatic release message (1C) for non-express air cargo for Entry Type 86 to ensure that CBP has sufficient time to review entries and notify filers of holds”. If documentation is received after arrival, a Type 86 entry cannot be processed. The entry will need to be filed as an Informal Type 11 entry or Formal Type 01 entry.
