UFLPA Entity List continues to grow
Tariffs on Canada, Mexico, China
The U.S. President signed three executive orders imposing tariffs on imports from Canada, Mexico and China. While those for Mexico and Canada have been delayed for an additional month, effective 4 February 2025, at 12:01a.m. EST all imports from China and Hong Kong will have an additional 10% duty rate. According to the White House, these tariffs address the national emergency posed by illegal aliens and drugs, including fentanyl, under the International Emergency Economic Powers Act (IEEPA).
UFLPA Entity List continues to grow
On 30 January, 2025, the U.S. Department of Homeland Security (DHS) announced 37 companies were added to the Uyghur Forced Labour Prevention Act (UFLPA) Entity List. All 37 companies are based in the People’s Republic of China (PRC). This latest update brings the total number of entities on the UFLPA Entity List to 144.
USMCA interim final rule
The interim final rule (IFR) published in the Federal Register on 17 January, 2025, provides additional implementing regulations for the agreement between the United States of America, the United Mexican States and Canada (USMCA). These regulations address general definitions, drawback and duty-deferral programmes, textile and apparel goods and automotive goods. This IFR will be effective 18 March 2025.
CPSC final rule
The U.S. Consumer Product Safety Commission (CPSC) approved a final rule to implement electronic filing (eFiling) of certificate information for regulated, imported consumer products and to revise requirements for Certificates of Compliance. CPSC’s new eFiling programme will go into effect 8 July 2026 and apply to all imported consumer products subject to a mandatory safety standard. Data elements at the time of filing an entry include:
- Identification of the finished product
- Party certifying compliance
- Each consumer product safety rule to which the finished product has been certified
- Date and place the finished product was manufactured
- When and where the finished product was most recently tested for compliance
- Contact information for the person maintaining test records
Section 321 warning (Release 2)
On 18 January, 2025, U.S. Customs and Border Protection (CBP) deployed a warning in ACE for deliveries potentially exceeding the $800 de minimis threshold. By 18 February 2025, CBP plans to withhold release of ineligible deliveries to enforce this threshold. The automation of entry type 86 testing participants' removal and restoration has been delayed until April. Additionally, bond validations for low-value deliveries, requiring carriers to provide cargo details and enabling CBP to verify active bonds, are scheduled for July.
